Legislators are painting with a broad brush. The problem of course is that there are literally hundreds of types of devices. Some with seats, some with pedals, some must be pedaled some not. The state legislatures are not being educated on common sense ways to differentiate and classify EB's and LES's. There is also the distinction between gas and electric devices that may also be overlooked (intentionally or not) by state legislatures.
The industry has matured now and it is time to work together on positive, meaningful legislation before the government regulators overregulate the products and cause them to be priced out of the market or make it just as difficult for users to purchase and operate them as a car, by requiring a license, registration and insurance, something that human powered bikes and users are not required to possess. The President signed HR 727 that defines the Low-Speed Electric Bicycle and the language of this law is reproduced here

An Act
To amend the Consumer Product Safety Act to provide that low-speed electric bicycles are consumer products subject to such Act
 
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. CONSUMER PRODUCT SAFETY ACT.
The Consumer Product Safety Act (15 U.S.C. 2051 et seq.) is amended by adding at the end the following:
LOW-SPEED ELECTRIC BICYCLES
SEC. 38. (a) Notwithstanding any other provision of law, low-speed electric bicycles are consumer products within the meaning of section 3(a)(1) and shall be subject to the Commission regulations published at section 1500.18(a)(12) and part 1512 of title 16, Code of Federal Regulations.
(b) For the purpose of this section, the term `low-speed electric bicycle' means a two- or three-wheeled vehicle with fully operable pedals and an electric motor of less than 750 watts (1 h.p.), whose maximum speed on a paved level surface, when powered solely by such a motor while ridden by an operator who weighs 170 pounds, is less than 20 mph.
(c) To further protect the safety of consumers who ride low-speed electric bicycles, the Commission may promulgate new or amended requirements applicable to such vehicles as necessary and appropriate.
(d) This section shall supersede any State law or requirement with respect to low-speed electric bicycles to the extent that such State law or requirement is more stringent than the Federal law or requirements referred to in subsection (a).
SEC. 2. MOTOR VEHICLE SAFETY STANDARDS.
For purposes of motor vehicle safety standards issued and enforced pursuant to chapter 301 of title 49, United States Code, a low-speed electric bicycle (as defined in section 38(b) of the Consumer Product Safety Act) shall not be considered a motor vehicle as defined by section 30102(6) of title 49, United States Code.

Victoria Road Rules Safety - Scooters
Any petrol powered scooter must be registered under normal motorcycle regulations regardless of engine power and a motorcycle riders licence is required. Fines up to $818   Motorised electric scooters with a power output of 200 watts or less can be used on low speed public roads which have no dividing lines or median strip. Also on footpaths less than 10kpm. Riders must wear an approved bicycle helmet, scooter must have brakes, a horn, front and rear lights. These scooters are not required to be registered.   Power assisted bicycles, 200 watt or less power limit applies.  
Fines - Bicycle offences, includes scooter offences incur a $50.00 fine.
NSW Road Rules & Safety  
Motorised scooters with a power output of less than 200 watts are classified as Bicycles, and can be ridden wherever bicycles are permitted to be ridden. They may not be ridden on footpaths unless the rider is under twelve years of age. Riders must wear an approved bicycle helmet. Vehicle registration is not required.  
Fines - Bicycle offences incur a fine of $45.00.
Queensland Road Rules and Safety - Scooters
You must be 16 years of age or over to ride a motorised scooter. If the motorised scooter has a seat, you must have a drivers licence. Motorised scooters with a power output of less than 200 watts can be ridden wherever bicycles are permitted to be ridden. Motorised scooters may be ridden on bikeways, shared paths and local streets. Motorised scooters can only be ridden on footpaths with the power off (unless signage indicates otherwise). Riders must wear an approved bicycle helmet.
Fines - For cyclists/scooter riders over 16 years: not wearing a securely fitted helmet of an approved design - fine $30.00. riding on a footpath in a manner dangerous to pedestrians - fine $30.00
South Australia Road Rules & Safety - Scooters     Motorised Scooters
 To ride a motorised scooter you must have a drivers licence (except if using on private property only). Under the National Road Rules, motorised scooters are classified as Bicycles. Therefore you must comply with the Bicycle Road Rules when riding a motorised scooter. While motorised scooters are classified as Bicycles under the National Road Rules, under the Motor Vehicle Act of SA they are classified as Motorised Vehicles. This means that you must register your motorised scooter (unless for use on private property only). See how to register a Motorised Scooter below. You must always carry your vehicle registration permit when riding a motorised scooter on the road. You must wear a safety helmet. You must not ride at night. The scooter must have a warning device (horn, bell etc). How to register a Motorised Scooter < 200 Watt Power Output To register a motorised scooter with a power output of less than 200 watts, you must purchase a temporary permit from a Transport South Australia Service Centre.
Western Australia Road Rules & Safety - Scooters & Motorised Scooters

Tasmania Road Rules & Safety - Scooters
It is illegal to ride motorised scooters in Tasmania , except on private property.
* Non motorised, or kick scooters, are permitted.
* Kick scooters and bicycles are allowed to be ridden on selected footpaths in Tasmania .

Kick scooters are allowed on roads except:
- those with a dividing line or median strip; or
- roads with a speed limit higher than 60km/hr; or
- between sunset and sunrise.  
Children under 12 are prohibited from riding kick scooters on roads.
Australian Capital Territory Road Rules & Safety - Scooters
Motorised scooters with a power output of less than 200 watts are classified as Bicycles, and can be used wherever bicycles are permitted to be ridden.   They may not be used on footpaths unless the rider is under twelve years of age.   Riders must wear an approved bicycle helmet.
Northern Territory Rules & Safety - Summary
Motorised scooters are classified as a motor vehicle. However, the Northern Territory Government does not issue motor vehicle registrations for scooters. Scooters are therefore only allowed to be ridden on private property.

Transport Department Law Changes
Electric Vehicles New Zealand Transport Department Law Changes - Electric Vehicles are now effective. . Recent changes in legislation, Kiwis will now be able to buy the best and safest power assisted bicycles from anywhere in the world. Key provisions in the new legislation that are of considerable interest.
Agency responsible for provisions: Land Transport New Zealand & NZ Police states "Any motorised vehicle with a power output of less than 300 watts will not be defined as a motor vehicle under the law. The Director of Land Transport NZ also has discretionary provision to exclude vehicles with motors up to 600 watts from being motor vehicles.

Agency responsible for provisions: Land Transport New Zealand & NZ Police Mobility devices designed for people who require mobility assistance and have motors of less than 1500 watts will not be defined as a motor vehicle under law.
